biopexFill Club Terms and Conditions

Thank you for joining the biopexFill Club. It’s great to have you in our biopexFill Club.

These Terms and Conditions govern your participation as a Member of biopexFill Club. You should read them carefully. You can find further information on biopexFill Club, including information on Benefits on www.club.biopexfill.com.

By using or accessing the biopexFill Club, you agree to these Terms and Conditions, as updated from time to time in accordance with Section 15 below. You can view the latest revision of Terms and Conditions of biopexFill Club via www.club.biopexfill.com/terms.

  1. Definitions

Account means the membership account assigned to a Member.

Activated Markets means the Markets in which the benefits, services, and facilities of the biopexFill Club are accessible for the Members.

Benefits means the benefits, services, and facilities from time to time, available to the Members in Activated Markets whether provided by Glopex via biopexFill Club.

biopexFill Club Platform means the platform which makes benefits, services, and facilities of biopexFill Club accessible to Members.

biopexFill Points means the points earned by Members for the purpose of progressing towards the Silver, Gold, or Diamond Membership Tiers.

Dashboard means a personal panel facing the Member, containing facilities to access the benefits, and services of biopexFill Club.

Deactivated Markets means the Markets in which the benefits, services, and facilities of the biopexFill Club are not accessible for the Members.

Exclusive Benefits means the benefits, services, and facilities from time to time, available exclusively to the Members in accordance with their Membership Tiers in Activated Markets whether provided by Glopex via biopexFill Club.

Free of Charge Products means the Promotion Products which supply to the Providers free of charge in accordance with their Membership Tier. Providers are not subject to earn biopexFill Point by registering the Serial Numbers of Free of Charge Products.

General Benefits means the benefits, services, and facilities from time to time, available to all Members in Activated Markets whether provided by Glopex via biopexFill Club.

General Offers means electronic communications (SMS, email, push notifications or social media etc.) with marketing communications, offers, news and market research from Glopex.

Global Price means the same price for Products that Glopex offers globally to Providers in all Markets.

Glopex means Glopex Co., Ltd.

Glopex Certified Clinics means the clinics that Glopex dedicates to Patients for enjoying special discount of using Products

Glopex Medical Committee means a committee consisting of three (3) medical specialists from time to time in Activated Markets appointed by Glopex.

Market Currency means the local currency in Activated Market

Markets mean any countries, territories, or regions where biopexFill Club temporarily or permanently activated or deactivated by Glopex.

Member means an applicable individual aged eighteen (18) who is registered as a member of biopexFill Club. A Member may be a Provider, and/or Patient, and/or Salesperson.

Membership means the membership of a Member in biopexFill Club.

Membership Card means in the case of Bronze, Silver, Gold, and Diamond, either a physical or a digital membership card.

Membership Number means the membership number allocated in accordance with section 2.3 of these Terms and Conditions.

Membership Tier means the tier level in biopexFill Club that entitles a member to receive a certain set of Benefits.

Membership Type means the type of membership of a Member in biopexFill Club with accordance in the usage of Products that may be a Provider, and/or Patient, and/or Salesperson.

Offer means any offer given by Glopex to the Members in accordance with section 9.3 of these Terms and Conditions.

Order means a direct order made by a Provider via biopexFill Club to Glopex

Patient means a Member who receives the injection of Product in his/her body of face.

Personal Data means any information that is related to a Member in accordance with section 11of these Terms and Conditions.

Products means the products of Glopex with Serial Number including biopexFill FINE, biopexFill DEEP, biopexFill SUB-Q, biopexFill FACE-S10, biopexFill LIPS-S10, and biopexFill BODy-V60. The products without Serial Number are not subject to these Terms and Conditions.

Promotion Products means the Products which supply to the Providers free of charge in accordance with their Membership Tier. Providers are not subject to earn biopexFill Point by registering the Serial Numbers of Promotion Products.

Provider means a Member who provides and injects the Product into the Patient’s face of body.

Registration Date means the date of registration of the Serial Number of a Product in biopexFill Club by a Member.

Salesperson means a Member who distributes the Providers in Activated Markets.

Serial Number means a specific number for each Product. The Products can be verified and registered by its Serial Number in accordance with Section 7 of these Terms and Conditions.

Special Offers means the offers given by Glopex to specific members for special events in accordance with section 9 of these Terms and Conditions.

Terms and Conditions mean these terms and conditions for biopexFill Club as amended from time to time.

Tier Renewal Date means twelve (12) months from the date of:

  1. the first Serial Number registration in Bronze Tier; or
  2. any subsequent renewal of the Membership Tier

in accordance with section 5 of these Terms and Conditions

  1. Joining biopexFill Club
    • Applicable individuals aged eighteen (18) years or over may apply for Membership as a Provider, Patient, and Salesperson by completing an application form on club.biopexfill.com/signin.
    • By applying for membership, you are required to agree to these Terms and Conditions. Membership is granted at the sole discretion of Glopex and Glopex may refuse Membership to any applicant.
    • Glopex will assign a Membership Number to each Member. Your Membership is not transferable, and you may not hold more than one (1) Account for each Membership Type. If Glopex identifies that you hold more than one (1) Account for each Membership Type, Glopex will then close your all Account(s).
    • You will not provide any false personal information on biopexFill Club or create an Account for anyone other than yourself without permission.
    • If Glopex disables your Account, you will not create another one without Glopex permission.
    • Glopex requests your consent to receive transactional, informational and marketing communications (e.g. redemptions and a statement of Account or offers, news and updates from biopexFill Club, or Glopex) by SMS, email or social media channels when you apply for membership of biopexFill Club. You may also provide consent after your enrolment in biopexFill Club. Glopex will send all biopexFill Club correspondence to the most recent email address that you have notified to it in relation to your Account. You may withdraw your consent at any time in writing to Glopex, by logging into your Membership Account or by any other means for withdrawing consent made available by Glopex from time to time.
    • You must immediately inform Glopex of any change of name or contact details. You can update most of your details online from your “My Profile” in your personal Dashboard at www.club.biopexfill.com. Failure to provide up-to-date information may limit your ability to access Benefits and may result in Glopex terminating your Membership. We will not be responsible for late, lost or misdirected mail.
    • We reserve the right to audit a Member’s Account and records without notice to the Member to check for compliance with these Terms and Conditions.
    • You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your Account.
  1. biopexFill Club Activated and Deactivated Markets
    • Glopex may activate or deactivate biopexFill Club in its discretion in certain markets, countries, territories, or regions (collectively “Markets”) temporarily or permanently.
    • The Members in Activated Markets are subject to receive the Benefits of biopexFill Club in accordance with Section 8 below.
    • The Members in Deactivated Markets are not subject to receive the Benefits of biopexFill Club and only they will verify the Products.
    • Glopex may give access to the Members in certain Deactivated Markets in its discretion to receive some Benefits. 
  1. Membership Cards
    • Members will receive a digital Membership Card only, which is downloadable for printing out or digital wallet from his or her personal Dashboard.
    • The Membership Card will show your name and Membership Type and Membership Number.
    • Only the Member named on the Membership Card may use it or quote the Membership Number. Membership Cards are not transferable.
    • It is Members’ responsibility to keep secure any information that might identify you and allow access to your Membership. You must contact Glopex as soon as you realize that your Membership Card or Membership Number or those of related members has been lost, stolen or misused or you accidentally reveal your Membership Number or password details. Until you contact Glopex, you may be liable for all unauthorized use of your Membership Card, Membership Number, biopexFill Points or Benefits.
    • Membership Cards remain the property of Glopex and must be surrendered to a Glopex representative upon request. 
  1. Membership Tiers
    • biopexFill Club has four (4) Membership Tiers: Bronze, Silver, Gold, and Diamond. Your Membership Tier status determines the Benefits you will receive from Glopex. New Members join biopexFill Club at the Bronze Membership Tier.
    • You will progress to a higher Membership Tier if you earn enough biopexFill Points in a consecutive twelve (12) month period. Once you move to a higher Membership Tier, your new Membership Tier will be valid for twelve (12) months.
    • Glopex will renew your Membership Tier on the Tier Renewal Date if you meet either of the renewal requirements for your Membership Tier. The renewal requirement is based on the number of biopexFill Points you have earned during the previous twelve (12) months. His/her biopexFill Points will expire with Membership Tier upgrading, i.e. an existing Provider with Gold Membership Tier with 7,000 biopexFill Points becomes Diamond Tier Member with 0 biopexFill Points. 50% of His/her biopexFill Points will be expired with Membership Tier retaining, i.e. an existing Provider with Gold Membership Tier with 3,200 biopexFill Points retains Gold Tier Member with 1,600 biopexFill Points.
    • Once your Membership Tier is renewed or retained, it will be valid for twelve (12) months. Should the Member fail to retain his or her existing Membership Tier, he or she shall be downgraded to the next lower tier, regardless of his/her biopexFill Points earnings over the past 12 months and the 50% of his/her biopexFill Points will be expired, i.e. an existing Provider with Diamond Membership Tier with 4,000 biopexFill Points will become Gold Tier Member with 2,000 biopexFill Points, and an existing Provider with Gold Membership Tier with 3,000 biopexFill Points becomes Silver Tier Member with 1,500 biopexFill Points.
    • The first twelve (12) month period of Membership in Bronze Membership Tier starts at 23:59 Seoul local time (GMT+9) on the first Serial Number (S/N) Registration Date.
    • Membership Tier renewal is processed at 23:59 Seoul local time (GMT+9) on the Tier Renewal Date.

  1. Termination of Membership
    • You may terminate your membership at any time. You can do this online at www.club.biopexFill.com after logging into your profile. All accrued biopexFill Points and Membership Tier Benefits will be forfeited. Termination of Membership does not relieve the Member of any continuing obligations under these Terms and Conditions.
    • In the event of the termination of Membership, please destroy your Membership Card related to your Account.
    • Glopex may suspend or terminate your Membership at any time with immediate effect if:
      1. you are involved in, or Glopex reasonably suspects that you are involved in, a fraudulent, irregular, dishonest or suspicious activity in connection with your Account, or the Account of another Member. Examples include (without limitation):
        1. altering documents to procure biopexFill Points and any kind of Benefits;
        2. knowingly supplying incorrect information to accrue biopexFill Points and any Benefits;
  • attempting to procure or avail biopexFill Points or Benefits for Products which you (or, if applicable, another person(s)) have not used or for which you are not eligible for biopexFill Points or any Benefits; and
  1. using or attempting to use stolen or counterfeit Products; or
  1. Glopex considers that your behavior or actions constitute misconduct. Examples include (without limitation):
    1. failure to comply with these Terms and Conditions;
    2. misuse of Benefits which are available to Members; and
  • using threatening, abusive or insulting language or behaving in a threatening, abusive or insulting manner when dealing with any staff or representatives of Glopex.

In the event of suspension or termination of your Membership, Glopex will write to inform you. Glopex may cancel all accrued and accruing biopexFill Points, Membership Tier Benefits.

  • Glopex may in its sole and absolute discretion end the biopexFill Club for any reason at any time but will use reasonable endeavors to give at least three (3) months’ notice to you. At the end of this notice period, your right to use any accrued biopexFill-Points, Benefits will cease.
  • Upon the death of a Member, the deceased Member’s biopexFill Points may, at Glopex’ discretion, be transferred to another Member upon provision of appropriate documentation such as a death certificate and proof of beneficiary, within twelve (12) months of the Member’s death. This transfer will not affect the biopexFill Points Expiry Date for the transferred biopexFill Points and the deceased Member’s Account will be closed thereafter.
  • In the event of termination of Membership, all data included in your Account will be removed from all active databases and will be securely archived for a period of fifteen (15) years for Glopex legal purposes in accordance with Section 11 below. 
  1. Product Registration, Earning and Missing biopexFill Points
    • Products can be verified by registering the S/N of the opened sealed Products in www.club.biopexFill.com.
    • biopexFill Points can be earned in Activated Markets by
  2. Providers via registering the S/N of the opened sealed Products in www.club.biopexFill.com;
  3. Patients via registering the S/N of the opened sealed Products in www.club.biopexFill.com;
    • Members will not earn biopexFill Points for
  4. the Products without S/N;
  5. the Promotion Products;
  6. the Products which already used its S/N by another Members in a same Membership Type;
  7. the Members in Deactivated Markets;
    • Providers are not subject to earn biopexFill Point by registering the S/N of the Promotion Products.
    • You can find full details of biopexFill Points earning opportunities with Glopex, on club.biopexfill.com.
    • You are responsible for ensuring that any biopexFill Points have been properly credited to your Account. You can check your statement online at club.biopexfill.com.
    • If biopexFill Points (if applicable) for a biopexFill item are not credited to your Account, you may submit a claim for the missing biopexFill Points online at club.biopexfill.com/report.
    • Glopex may ask Patients to provide and upload before and after photos for approving the Products injection.
    • Glopex encourages all members to add the S/N of each item to the relevant Membership Account just after receiving S/N at the time of opening the sealed box.
  1. Membership Benefits
    • Members in all Membership Tiers in Activated Markets are subject to receive General Benefits and Exclusive Benefits (collectively “Benefits”).
    • Providers are subject to receive below Exclusive Benefits in certain Membership Tiers:
      1. Free of Charge Products for all Membership Tiers;
      2. Payment credit for Silver, Gold, and Diamond Membership Tiers;
      3. Visiting Glopex Workshop and Exhibitions, one (1) visit in a year for Gold Members and two (2) visits in a year for Diamond Members;
    • Patients are subject to receive below Exclusive Benefits in certain Membership Tiers:
      1. Discount in Glopex Certified Clinics;
      2. Free Pick up/Drop off services to Glopex Certified Clinics for Gold and Diamond Members;
      3. One (1) free beauty tour in South Korea sponsored by Glopex in a year; The conditions of the tour such as duration and type of supports will be defined and informed at the time of beauty tour awarding to the awarded Patient. Glopex has right to use the awarded patient beauty tour reports such as phots, movies, surveys for its public advertisement and promotion purposes;
    • Exclusive Benefits are valid for one year as long as you retain your tier.
    • You can find full details of General Benefits and Exclusive Benefits of each Membership Tier on club.biopexfill.com.
    • If a Benefit (if applicable) is not credited to your Account, you may submit a claim for the missing Benefit online at club.biopexfill.com/report.
  1. General and Special Offers
    • If you give us your consent to do so, Glopex can send you electronic communications (SMS, email, push notifications or social media etc.) with marketing communications, offers, news and market research from Glopex (collectively “General Offers”).
    • Glopex may give Special Offers in its discretion to specific Members for special events.
    • Each General Offer and Special Offer (collectively “Offer”) is governed by its respective terms and conditions. Glopex will provide these terms and conditions, or details of where you can find them, when they inform you of the Offer. The terms and conditions of any Offer take precedence over any other statement in these Terms and Conditions.
    • Glopex may limit Offers in connection with BiopexFill Club to specific Members.
  1. Limit of Liability
    • Glopex will not be liable for any kind of loss or damage, including (without limitation) any loss or reduction in a Member’s advantages and any detriment or disadvantage, resulting from any alteration to or termination of biopexFill Club, the right to earn or redeem biopexFill Points, or any of the Benefits.
    • Glopex is not responsible for any tax liability you or any third party incurs in connection with your biopexFill Club Membership.
  1. Personal Data and security of Account
    • Glopex is committed to protecting your privacy. By becoming a Member, you agree that the biopexFill Club may process and disclose your Personal Data in the performance of these Terms and Conditions.. Personal Data will be processed for the purposes of enrolling you into biopexFill Club, administering the biopexFill Club and providing you Benefits or Awards.
    • We may collect and receive Personal Data directly from you, or from your authorized representative(s). We may also collect Personal Data when you:
      1. enroll yourself into the biopexFill Club;
      2. register, create or modify an Account;
      3. when you use biopexfill.com or www.club.biopexfill.com
      4. when you upload before and after photos
      5. communicate with us by raising a service request, telephone, in writing or through our helpdesk pages;
      6. enter promotions; or
      7. if you choose to complete surveys and or voluntarily provide information by other means.
    • Glopex may process Personal Data for one or more of the following purposes:
      1. To process and administer your application to join biopexFill Club;
      2. For the operation and management of biopexFill Club including biopexFill Points tracking, delivery of associated Benefits and services, research and program and App development, as well as delivering news and information to Members, and for other record-keeping purposes related to biopexFill Club;
      3. For identification and verification purposes, in connection with any of the Benefits, other products or services that may be supplied to you;
      4. To maintain and support your Account and facilitate your access to it;
      5. To fulfil requests submitted by you, whether online or through our mobile services and App, or through other methods;
      6. To pass on to and for the use by any member of the Glopex in connection with the performance of the Terms and Conditions with you;
      7. To respond to, handle and process any orders, enquires, claims, reports or complaints submitted by you;
      8. For management, marketing and informational purposes, such as conducting market research, data analysis, program or App development, and defining Glopex strategies (e.g. marketing, sales, logistics, management, production, Research and Development strategies and etc.)
      9. To send you updates on the latest Offers and promotions, or transactional (e.g. redemptions and a statement of Account) in connection with biopexFill Club and for assessing eligibility for any marketing and/or promotional activities and/or any Offers from biopexFill Club;
      10. To administer promotions conducted by us or on our behalf, including announcing the winner of any such competition;
      11. To comply with legal, accounting, audit and regulatory requirements;
      12. To improve our security, including in relation to the processing of payment by credit card to guard against the risk of fraud, including carrying out matching procedures against databases of known fraudulent transactions (maintained by us or third parties);
      13. To monitor and improve the service that biopexFill Club provides to you; and
      14. For business purposes, and to relevant third parties for the purpose of fraud protection and credit risk reduction and for administrative purposes.
    • Before Glopex discloses any of your Personal Data to you, you may be asked security questions which may require you to confirm your identity by providing information held by Glopex about you.
    • You are responsible for the security of your Account and Glopex shall have no liability in the event that you disclose your logon and/or password, whether intentionally or not, so as to allow a third person online access to your Personal Data and to make any transactions. Glopex reserves the right to block online access to your Personal Data by or through any third party website not authorized by Glopex.
    • You are responsible for keeping your contact details up to date. Glopex is not responsible for any loss or damage resulting from your failure to notify a change in address or other changes to your Personal Data.
    • You irrevocably waive any claim against Glopex with respect to such third party websites and products and services which they may offer. Glopex is not liable for any loss or damage caused or alleged to be caused by or in connection with your access or use of any such third party websites or other services, or your reliance on the privacy practices, data security processes or other policies of such third parties.
  1. Ordering and Cancelation
    • Only Providers in Activated Markets can make Order directly to the Glopex via club.biopexfill.com.
    • Glopex supplies the Products with its Global Price through its Salesperson who is dedicated to the Provides in biopexFill Club. Providers can check the information of dedicated Salesperson in their personal Dashboard.
    • Payment of the Order is in the Market Currency and must be locally paid to the dedicated Salesperson.
    • Glopex will not be liable for any kind of loss or damage due to changing the Market Currency exchange rate in exchanging the Global Price for the local Market Currency.
    • Provider Members can cancel their order
      1. Any time before Product delivery
      2. By contacting the dedicated Salesperson any time after Product delivery
      3. With returning the Promotion Products
  1. Reports and Claims
    • Members in all Membership Tiers in Activated Markets are subject to report their claims via club.biopexfill.com/reports.
      1. Providers are subject to report the claims for
        1. Any side-effect incurred by using Products;
        2. Global Price of Products;
  • biopexFill Points;
  1. Membership Tiers and Membership Benefits;
  2. Products ordering and cancelation;
  1. Patients are subject to report the claims for
    1. Any side-effect incurred by using Products;
    2. biopexFill Points;
  • Membership Tiers and Membership Benefits;
  • If any Member reports a side-effect incurred by using the Products in Activated Market, the Local Glopex Medical Committee in the relevant Market checks the validity of the claim. Glopex will imburses the damages caused by side-effects of Products if the Glopex Medical Committee approves the damage incurred due to Product side-effects.
  1. biopexFill Club Platform
    • We take reasonable care in providing biopexFill Club Platform, but we can’t guarantee that everything on it is accurate. To the extent permitted by law, we can’t be held responsible for any errors, any interruptions, or any missing bits of information – although we will do everything we can to correct/fix them as soon as we can.
  1. Modification
    • These Terms and Conditions are effective from the Date of Last Revision on www.club.biopexfill.com/terms. Glopex may change any of these Terms and Conditions, as well as the operation or Benefits of biopexFill Club, at any time. While prior notice of changes to these Terms and Conditions may not always be possible due to operational or other considerations, Glopex will endeavor to give you reasonable notice of any material changes via www.club.biopexfill.com.
    • Your continued use of the biopexFill Club, following notice of the changes to these Terms and Conditions, constitutes your acceptance of our amended Terms and Conditions, policies or guidelines.
  1. Applicable Law and Forum

To the extent permitted by mandatory local (Members) law, any dispute will exclusively be submitted to the competent courts in Republic of Korea.
